The Property Agents and Land Transport Ministerial Declaration has been signed off by all jurisdictions, enabling mutual recognition of licensing nationally for property agents and land transport.
Additional schedules included as part of the Ministerial Declaration include:
- Driving instructors
- Drivers transporting bulk dangerous goods and explosives
- Miscellaneous licenses (pilot and escort drivers)
- Passenger vehicle drivers
- Property agents
- Valuers
- Conveyancers.
After being registered on the ComLaw Federal Register of Legislative Instruments on March 23, the declaration is now recognised as law under Section 32 of the Mutual Recognition Act 1992.
The changes are a result of collaborataion between states, territories and the Commonwealth working through the Council of Australian Governments (COAG).
The rationale behind mutual recognition agreements is to address the frustration which businesses face when operating in multiple regulatory environments.
Prior to the Act’s introduction in 1992, the existence of various regulations across states and industries restricted trade and international competition.
As the law now encompasses property agents and land transport, it will encourage business and maximise efficiency.
Queensland Premier Anna Bligh signed off on the amendments in September 2008.
